CONDITIONS OF PARTICIPATION

in tourist events organized by the Tour & Travel Poland,
hereinafter referred to as T & T Poland.

"Conditions of participation" define the mutual obligations arising in connection with the conclusion of the tourist service provision agreement among the participants of events and T & T Poland.

I. AGREEMENT, RIGHTS AND OBLIGATIONS OF THE PARTIES

1. The conclusion of the agreement for participation in a tourist event takes place by signing the tourist services provision Agreement by the travel office and the Customer. At the same time the Customer has to make a deposit payment or full package price set out in Part II, 1 hereof. The participant of the event is the Customer signing the tourist events service provision Agreement and other people mentioned by him in the contract.




2. It is possible to conclude the tourist services provision agreement via the Internet through the website reservation at T & T Poland, or via e-mail. The terms of the contract and the way of concluding it is given in this case at the time of confirming the benefits' reservation. Detailed information on programs, types and standards of service for tourist events organized by T & T Poland are set forth in current price lists and newsletters.



3. T&T Poland is committed to the execution of benefits qualitatively and quantitatively consistent with the benefits specified by the contract.



4. T&T Poland is responsible for the failure or improper performance of executing the tourist service provision agreement unless its performance or improper performance is due only to an act or omission of the Customer, by an act or omission of third parties not participating in the execution of services provided in the contract and if such acts or omissions could not be foreseen or avoided or caused by force majeure.




5. T&T Poland will refund the value of outstanding customer services, or the difference in value between the benefits of the contract, and the replacement benefits if the client has not received the benefits of replacement of equal or greater value.




6. T&T Poland shall not be liable for services purchased by Customer in the place of destination of the tourist event directly from the local business service providers.




7. The client of a tourist event is responsible for the damages caused by him or people in his care during the tourist event at their inception (hotel, bus, etc.).

II. PRICE AND TERMS OF PAYMENT

1. At the time of concluding the Agreement, the Customer must pay a downpayment - 40% of the price of the event, and in case when the Agreement was concluded within less than 31 days before the event - all the agreed price. After paying the downpayment, the payment of the remaining amount should be made not later than 31 days before the commencement of the event.




2. No payment of the remaining part of the package within the time limit set in point. 1 means the withdrawal by the Customer and generates the effects defined in Part III. 3 and 4 of the Terms of Participation.




3. The tourist service provision Agreement is a personal document for the persons mentioned in the document and can not be released to third parties without notice to T&T Poland.




4. Unless the contract states otherwise, the fee reports, local fees, optional benefits are not included in the price of the event and are payable locally.




5. Prices of the events are expressed in PLN. For events away with individual transport or with special events, the price is a PLN equivalent of the price given in Euro according to the Polish National Bank's exchange rate at the date of full payment or payment for the full price of the event.




6. T&T Poland may increase the price of the event only when documenting the impact of increasing the price of the following circumstances:
   
   - Increase in transport costs
   
   - Increase of VAT tax, fees payable for services such as: airport, loading or trans-shipment in seaports or airports
   
   - changes in currency exchange rates
   
   Raising the price can take place no sooner than 21 days before the event. T&T Poland shall immediately inform the customers about the change in price.

III. CHANGES, CANCELLATION, REFUNDS

1. If a need to change the program or package price occurs T & T Poland shall promptly notify the customer who, within 3 days of receipt of the notice should inform T & T Poland whether he accepts the proposed changes or withdraws from the contract. No information about the acceptance of the changed conditions authorizes T&T Poland to recognize it as client's resignation from participation in a tourist event, and the client receives a refund of the entire amount paid for the event.




2. The Customer may report the resignation from the event at any time before the event has begun, by submitting it in writing in the office / travel agent, in which the contract was concluded.




3. The Customer will receive a refund of the amount paid towards the price of the event after deducting costs incurred by T & T Poland associated with the organisation of the event. The refund of the difference between the deposited amount and the amount of deductions will be made in the place where the signing of the Agreement for the provision of tourism services took place.
   
   T & T Poland will deduct a lump-sum rate for balancing the costs and expenses associated with the preparation of the event:
   
   - 10% of package price per person, if it is cancelled within 60 - 31 days before the date of the event, and noted agreement
   
   - 10% of the price per person for the tourist event and costs incurred by the organizer in connection with the cancellation of the requested benefits, if the resignation occurred within 30 - 21 days before the date of the event, and noted agreement
   
   - 100% of the price per person or 20% of price per person and costs incurred by the organizer in connection with the cancellation of the requested benefits, if the application is cancelled within 20 days or less before the date of the event, and the contract does not state otherwise.




4. T&T Poland on customer's request, towards whom the deductions for the resignation of the event were made, will submit a calculation of the individual costs and expenses which T&T Poland actually incurred and which were associated with the preparation of this event.

IV. COMPLAINTS

1. While the duration of a tourist event, the customer finds any defective execution of the contract, he shall promptly notify the employee of the sales offices and the contractor of the services. If a defect in contract execution will not be deleted, You have the right to ask T&T Poland for adequate compensation.




2. Not subjected to filing a complaint, is a defect of which the client knew or was aware at the time the contract (eg, a closed beach, renovations at the resort or the area).




3. The guide, the local representative of the organizer or the service providers are not entitled to accept the claims of the customer.




4. The customer may submit in writing within 30 days after the end of the event claims on account of noticed flaws or defects in the execution of the Agreement, in the place where the contract was concluded or at the organizer's office. If the claim relates to defects or deficiencies noticed during the event,it should have information about the date, form and method of notification of such defects during the event.




5. T&T Poland is obliged to answer the complaint in writing immediately but not later than 30 days from the date of the complaint.




6. T&T Poland limits its liability for improper performance of services during the event, except for personal injury, to double the package price of each customer.

V. FINAL PROVISIONS

1. The client declares that the state of his health enables him to participate in the event.




2. The client agrees under the Law on Personal Data Protection dated 29 August 1997 for processing, updating, sharing and storing their personal data in order to implement the package and travel to T&T Poland.




3. In matters not covered by the Agreement for the provision of tourist services and these Terms of Participation are applied:
   
   - Law on tourism services of 29 August 1997 (uniform text. Laws of 2004, No 223, item. 2268, as amended)
   
   - Civil Code
   
   - Other consumer protection provisions

T&T Poland in accordance with the law on tourist services, has a certificate issued by the Governor of Małopolska to enter this company to the Register of tourist organizations and agencies on the number Z/2/2010.
